Terms and Conditions of Sale

These terms and conditions of sale are agreed between, on the one hand, MARJ SASU, a company with a share capital of €1,000, whose registered office is located at 106 rue Ferrari, 13005 Marseille, registered with the Marseille Trade and Companies Register under number 901 727 669 00011, hereinafter referred to as ‘MARJ’, which manages the website www.marj-label.com, and, on the other hand, any individual or legal entity wishing to make a purchase via the website www.marj.fr. hereinafter referred to as ‘MARJ’ and managing the website www.marj-label.com, and, on the other hand, by any natural or legal person wishing to make a purchase via the website www.marj-label.com, hereinafter referred to as ‘the buyer’.

Article 1. Purpose

These terms and conditions of sale are intended to define the contractual relationship between MARJ and the buyer and the conditions applicable to any purchase made through the website www.marj-label.com. The purchase of a product through this website implies the buyer's unreserved acceptance of these terms and conditions of sale, which the buyer acknowledges having read prior to placing their order. Before any transaction, the buyer declares, on the one hand, that the purchase of products on the website www.marj-label.com is not directly related to their professional activity and is limited to strictly personal use and, on the other hand, that they have full legal capacity, allowing them to commit to these general terms and conditions of sale.

MARJ reserves the right to modify these terms and conditions of sale at any time in order to comply with any new regulations or to improve the use of its website. Therefore, the applicable terms and conditions will be those in force on the date of the buyer's order.

Article 2. Products
The products offered are those listed on the MARJ company website www.marj-label.com, subject to availability. MARJ reserves the right to modify the product range at any time. Each product is presented on the website in the form of a description detailing its main technical characteristics (composition, origin, use, etc.). The photographs are as accurate as possible but are not binding on the Seller. The sale of products presented on the website www.marj-label.com is intended for all buyers residing in countries that fully authorise the entry of these products into their territory, as specified on the ‘Payment and Delivery’ page. MARJ reserves the right to modify this list of countries at any time.

Article 3. Prices
The prices listed on the product pages of the online catalogue are in euros (€) and include all taxes (VAT included), taking into account the VAT applicable on the day of the order. Any change in the VAT rate may be reflected in the price of the products. MARJ reserves the right to modify its prices at any time, it being understood, however, that the price listed in the catalogue on the day of the order will be the only one applicable to the buyer. The prices indicated do not include delivery costs, which are invoiced in addition to the price of the products purchased, depending on the total amount of the order. In mainland France, for any order greater than or equal to £150 including VAT, delivery is free. For any order less than £150 including VAT or to a country other than mainland France, a flat-rate contribution to shipping costs will be charged to the buyer. This amount will be calculated before payment and is based on the weight of the order and the current rates applied by the shipping partners. MARJ therefore reserves the right to pass on any price changes made by its logistics partners to the delivery costs.

Article 4. Ordering and payment terms
Before placing an order, the buyer has the option of creating an account on the website www.marj-label.com. The account creation section can be accessed directly from the ‘profile’ icon at the top right of the menu bar. Each time they visit the site, buyers who wish to place an order or view their account (order status, profile) can log in using this information.
MARJ offers buyers the option of ordering and paying for their products in several stages, with two payment options:
Secure payment by credit card (Visa, Mastercard or American Express via the STRIPE system) or Secure payment by PAYPAL (via the PAYPAL system). The buyer selects the products they wish to order in the ‘basket’, modifies if necessary (quantities, references, etc.), checks the delivery address or enters a new one. Then, the shipping costs are calculated and submitted to the buyer, along with the name of the carrier. Next, the buyer chooses their preferred payment method: ‘Payment by Credit Card’ or ‘Payment by PayPal’.
If the buyer chooses the ‘Credit Card’ option, they must enter their card details in the form and click on the ‘Check Order’ button. The next step allows them to check all the information and then invites them to confirm their order by clicking on the ‘Pay Now’ button. By clicking on this button, the buyer accepts the General Terms and Conditions of Sale set out herein.

The buyer will then be redirected to the secure PAYPAL interface to securely enter their Paypal account or personal credit card details. If the payment is accepted, the order is registered and the contract is definitively formed.
Payment by PayPal account or credit card is irrevocable. In the event of fraudulent use of the card, the buyer may demand cancellation of the card payment, and the sums paid will then be credited back or refunded. The cardholder is not liable if the disputed payment has been proven to have been made fraudulently, remotely, without physical use of their card. To obtain a refund of the fraudulent debit and any bank charges that the transaction may have incurred, the cardholder must dispute the debit in writing with their bank within 70 days of the transaction, or 120 days if the contract between them provides for this.

The amounts debited shall be refunded by the bank within a maximum period of one month after receipt of the written complaint lodged by the cardholder. No costs for the refund of the sums shall be charged to the cardholder.
Confirmation of an order implies acceptance of these terms and conditions of sale, acknowledgement of full knowledge thereof and waiver of the right to invoke one's own terms and conditions of purchase. All the data provided and the recorded confirmation will constitute proof of the transaction. If the buyer has an email address and has entered it on the order form, MARJ will send confirmation of the order by email.

Article 5. Retention of title
MARJ retains full ownership of the products sold until full payment has been received, including the principal, costs and taxes.

Article 6. Cancellation
Pursuant to Article L121-20 of the French Consumer Code, the buyer has a period of fourteen working days from the delivery of their order to exercise their right of cancellation and thus return the product to the seller for exchange or refund without penalty, except for the return costs.

Article 7. Delivery
Deliveries are made to the address indicated on the order form, which can only be within the agreed geographical area. Orders are delivered either by MONDIAL RELAY, a tracked delivery service, or to a pick-up point. Delivery times are given for information purposes only; if they exceed thirty days from the date of the order, except for geographical areas outside mainland France, the sales contract may be terminated and the buyer reimbursed. MARJ will provide the buyer with the tracking number for their parcel by email. MONDIAL RELAY will contact the buyer by email to inform them that their parcel is available for collection at a collection point, within a period specified in the email. Transport risks are borne by the buyer from the moment the items leave the premises of MARJ. The buyer is required to check the condition of the packaging and its contents in the presence of the MONDIAL RELAY representative at the time of collection. In the event of damage during transport, any complaint must be made to the carrier within three days of delivery.

Article 8. Guarantee
All products supplied by MARJ are covered by the legal warranty provided for in Articles 1641 et seq. of the Civil Code. In the event of non-conformity of a product sold, it may be returned to MARJ, which will take it back, exchange it or refund it. All complaints, requests for exchange or refund must be made by email to the following address: contact@marj-label.com, within thirty days of delivery, in accordance with the process set out on the ‘Returns and Refunds’ page.

Article 9. Liability
MARJ is only bound by an obligation of means in the distance selling process. It cannot be held liable for any damage resulting from the use of the Internet network, such as loss of data, intrusion, viruses, service interruption or other unintentional problems.

Article 10. Intellectual property
All elements of the www.marj-label.com website are and remain the exclusive intellectual property of MARJ. No one is authorised to reproduce, exploit or use for any purpose whatsoever, even partially, elements of the website, whether in the form of photos, logos, visuals or text, without prior authorisation.

Article 11. Personal data
MARJ undertakes to preserve the confidentiality of information provided by the purchaser, which may be required for the use of certain services. Any information concerning the purchaser is subject to the provisions of Law No. 78-17 of 6 January 1978. As such, the internet user has the right to access, modify and delete information concerning them. Article 12. Dispute resolution
These terms and conditions of distance selling are subject to French law.
